Conditions of Use

Payment

Payment for end customer orders must be made in advance by bank transfer or cash on collection. Payment must be made in full and in euros. Partial payments or foreign currencies are not accepted. Orders from resellers can only be paid on account, and invoices must be paid within 30 days of receipt. All expenses incurred during payment, such as bank charges and exchange fees, must be paid by the buyer and will not be refunded.

Delivery

All orders are only processed after receipt of payment or cash on delivery (at the buyer's expense). If delivery is delayed for any reason, the buyer will be informed immediately by us. Claims for damages due to late delivery are excluded.

Orders are normally sent as a registered letter or insured package by the Austrian Post. We reserve the right to use a different shipping method. The goods remain our property until full payment has been made.

If delivery is not possible because the address provided by the customer was not correct or complete or the delivery was not accepted or picked up by the customer, the buyer must bear the return costs of the parcel company. Alternatively, a new delivery attempt can be made at the customer's expense. If the goods are not picked up within 6 months or a new delivery is arranged, any claim to the ordered goods expires.The same applies to returns to the seller, in which case the buyer must also bear the costs; we do not accept returns that are not prepaid or have to be paid for. Before sending a parcel back, the buyer should contact the seller.

If there is damage to the packaging that suggests loss or damage to the contents, this must be reported to the transport company (e.g. post office) immediately. If damage is only discovered after acceptance, the damaged package must be returned to the transport company within 24 hours and acceptance must be refused afterwards. The transport company will send the damaged parts back to us and we will deliver replacements.

Damages

If the order cannot be carried out for reasons that are the responsibility of the buyer, we will charge a flat-rate compensation of 15% of the purchase price plus shipping and packaging costs. The buyer is free to prove to us that the damage is less.

Withdrawal from the contract

For private individuals, withdrawal from the contract is possible within 14 days of receipt of the goods due to the provisions of the Consumer Protection Act. The return costs are to be paid by the buyer and the return must be sent to the company address stated in the imprint. If the goods are returned in new condition and in the original packaging, we will refund the purchase price minus the shipping costs incurred.

Only locomotives and wagons that have not been test-driven, as well as unopened kit or accessory bags, are considered to be in new condition. In your own interest, please check before using the goods whether they meet your requirements. When returning items that are not in new condition, only the remaining resale value can be refunded. Legitimate complaints about defects in faulty products are of course not affected by this; these are also accepted for used models within the statutory time limits.

All custom-made items such as signals from our own production are explicitly excluded from the withdrawal, as these are only manufactured after the order has been placed to the customer specifications requested in the options. Furthermore, withdrawal from all services that can be ordered as product options (e.g. lighting installation) is not possible. The basic models modified by the ordered services cannot be returned either, as resale is not possible.

Prices

The prices listed in our online shop include statutory VAT. The price valid at the time of conclusion of the contract applies. In the event of subsequent price changes, the buyer has the right to withdraw from the purchase contract. Price changes, errors and prior sale reserved. All prices stated are daily prices.

Reservation

Goods that are constantly available from the manufacturer are only reserved or ordered for you when the advance invoice is issued. The delivery times stated in the online shop refer to the time from receipt of your payment in our account to handing over the goods to the commissioned shipping company. Special series, products sold out at the factory, etc. w
